Almond Flour Frosted Sugar Cookies ("we", "us", or "our") respects the intellectual property rights of others and is committed to complying with the provisions of the Digital Millennium Copyright Act (DMCA). This policy outlines our procedures for addressing alleged copyright infringement on our website and how copyright owners can submit notices of infringement, as well as how users can submit counter-notifications.

Filing a DMCA Infringement Notice

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on the Almond Flour Frosted Sugar Cookies website, you may notify our Designated Copyright Agent pursuant to the DMCA. To be effective, your notification must be a written communication that includes substantially the following:

  6. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Upon receipt of a valid DMCA notice, we will investigate the claim and take appropriate action, which may include removing or disabling access to the infringing material.

Filing a DMCA Counter-Notification

If you believe that material you posted on our website was removed or disabled as a result of mistake or misidentification, you may file a counter-notification with our Designated Copyright Agent. Your counter-notification must be a written communication that includes substantially the following:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Almond Flour Frosted Sugar Cookies may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.

Upon receipt of a valid counter-notification, we will forward a copy to the original complaining party. If we do not receive notice from the complaining party within 10 business days that they have filed an action seeking a court order to restrain the user from engaging in infringing activity relating to the material on our system, we may replace the removed material or cease disabling access to it.
